These Terms and Conditions (“Terms”) govern the use of services, facilities, equipment, and premises operated by VRNexGEN (“Company,” “we,” “us,” or “our”). By purchasing tickets, booking sessions, entering the facility, or participating in any activity, you agree to be bound by these Terms.

PLEASE READ CAREFULLY – THIS IS A LEGAL AGREEMENT

By purchasing a ticket, booking a session, checking a box online, signing electronically, or participating in any activity at VRNexGEN, you acknowledge that you understand and agree to the terms of this Liability Waiver, Assumption of Risk, and Release of Claims (“Waiver”).

1. ASSUMPTION OF RISK

I understand that participation in virtual reality, arcade, motion-based, and interactive entertainment activities involves inherent risks, including but not limited to:

  • Dizziness, nausea, motion sickness, or disorientation
  • Loss of balance, slips, trips, or falls
  • Collisions with walls, objects, equipment, staff, or other participants
  • Eye strain, headaches, or visual disturbances
  • Equipment malfunction or failure
  • Physical injury, emotional distress, or property damage

I voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from my participation or presence at the facility.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by California law, I hereby release, waive, discharge, and hold harmless VRNexGEN, its owners, officers, members, managers, employees, agents, contractors, volunteers, insurers, and affiliates from any and all claims, demands, causes of action, damages, losses, costs, or liabilities, including those arising from ordinary negligence, related to:

  • Participation in any VR or FEC activity
  • Use or misuse of equipment
  • Instruction or supervision by staff
  • Conditions of the premises

This release does not apply to gross negligence or willful misconduct, as prohibited by California law.

3. MEDICAL FITNESS & PARTICIPANT RESPONSIBILITY

I represent and warrant that:

  • I am physically and medically fit to participate
  • I do not suffer from conditions that may be aggravated by VR activities, including epilepsy, seizure disorders, heart conditions, severe motion sickness, vertigo, or pregnancy
  • I will immediately stop participation if I feel unwell or unsafe
  • I agree to follow all posted rules and verbal instructions provided by VRNexGEN staff

4. EQUIPMENT USE & DAMAGE

I agree to use all equipment only as instructed. I accept financial responsibility for damage caused by misuse, negligence, or failure to follow instructions.

5. PERSONAL PROPERTY

I understand that VRNexGEN is not responsible for lost, stolen, or damaged personal belongings.

6. PHOTOGRAPHY & VIDEO RELEASE (OPTIONAL)

I grant VRNexGEN permission to photograph or record me and use my likeness for marketing, advertising, or promotional purposes without compensation, unless I opt out in writing.

7. MINOR PARTICIPANTS – PARENTAL CONSENT

If I am the parent or legal guardian of a minor participant, I:

  • Consent to the minor’s participation
  • Agree to this Waiver on behalf of the minor
  • Assume full responsibility for the minor’s conduct and participation
  • Release VRNexGEN from claims brought by or on behalf of the minor to the fullest extent permitted by law

8. ELECTRONIC SIGNATURE & ACCEPTANCE

I understand that my electronic acceptance, checkbox acknowledgment, or digital signature constitutes a legally binding signature under the California Uniform Electronic Transactions Act (UETA) and has the same legal effect as a handwritten signature.

9. GOVERNING LAW & VENUE

This Waiver shall be governed by and construed in accordance with the laws of the State of California. Any legal action shall be brought exclusively in the county where VRNexGEN is located.

10. SEVERABILITY

If any provision of this Waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By signing below or accepting electronically, I certify that:

  • I have read and fully understand this Waiver
  • I understand that I am giving up legal rights
  • I am signing freely and voluntarily
  • I am at least 18 years old, or the parent/legal guardian of a minor participant
